These are the conditions of the contract between you ('you') and Izabela Zarek-Langowska trading as AdventureTime.co.uk. A contract is made when we or your travel agent confirm your booking. When you make a booking you accept these booking conditions on behalf of your party and accept responsibility for paying for the whole holiday. This contract is made on the terms of these booking conditions and is governed by English law. Please read them carefully before you book. Definitions “Us” and “We” means AdventureTime.co.uk “You” means the person making the holiday booking with AdventureTime.co.uk, also defined as “the Party Leader” “Party” means each person who will be going on the holiday as set out in the Booking Confirmation “Price” means the agreed price for the holiday as set out in the Booking Confirmation “Itinerary” means your holiday itinerary as set out in the Booking Confirmation “Booking Confirmation” means the written confirmation (supplied to You by AdventureTime.co.uk) of the details of the holiday to be arranged on your behalf by AdventureTime.co.uk ………………………………………………………………………………………………… Booking a tour or holidayOur tours are organized by AdventureTime.co.uk for direct benefit of the Customer. On our pages www.adventuretime.co.uk we propose various itineraries, but we are very open to all your suggestions and preferences. When you make a booking you are confirming that you understand and have accepted on behalf of yourself and all members of your party our terms & conditions and the details that you find in the particular trip dossier that is part of this tour and accept responsibility for paying for the whole holiday. No booking is accepted by AdventureTime.co.uk until we send to you the Booking Confirmation setting out the itinerary you have offered to purchase, together with the price and the full names of each member of your party. You are responsible for entering the correct information on the booking form. If you are under 18 years of age, you will need to mail us the scan of a printed copy of the filled out booking form, signed by your lawful parent(s) or guardian on each page. To secure your booking, you should complete and send the Booking Form to AdventureTime.co.uk with a deposit of 20% per person - or as advised by the Company. If you are booking within 8 weeks of departure, then full payment is required. ………………………………………………………………………………………………… Price We reserve the right to increase or decrease the prices of any unsold holidays at any time. Changes in transportation costs, including the cost of fuel, duties, taxes or fees chargeable for services such as landing taxes or disembarkation fees at ports and airports and exchange rates, mean that the price of your travel arrangements may change after you have booked. However there will be no change within 30 days of your departure. We will absorb and you will not be charged for any increase equivalent to 2% of the price of your travel arrangements, which excludes insurance premiums and any amendment charges. ………………………………………………………………………………………………… Payment procedures You will be required to pay a deposit for each member of your Party for the amounts and within the timescale set out in your Booking Confirmation. Payment can be made by most major credit cards. Full payment is due not less than 8 weeks before departure. If you do not pay in full 8 weeks before departure, we reserve the right to cancel your booking, and cancellation charges will apply. If the Price increases are imposed after the due date for payment has passed, payment shall be due within 7 days of the issue date of the revised Booking Confirmation. If payment in full in cleared funds is not made by the due date we shall have the right to treat your booking as cancelled by you by giving you written notice that you have failed to make full payment in cleared funds by the due date and that we are treating your booking as cancelled by you and cancellation charges will be applied in accordance with clause CANCELLATION BY YOU. ………………………………………………………………………………………………… Changes by us Great care is taken to ensure that the description and prices given in this brochure are accurate at the time of publication. However, in the event that we are constrained to make a significant change to your holiday we will notify you of such change as soon as possible and you will be given the option to cancel your holiday and all monies paid to us will be refunded (excluding any administration charges). You must notify to us as soon as possible whether you wish to accept the notified changes or to cancel your booking or accept an alternative holiday package. If we do not receive a reply from you within 48 hours of notifying you of the relevant changes we will be entitled to assume that you have decided to accept the relevant changes to your holiday. ………………………………………………………………………………………………… Changes by you If for any reason you wish to make changes to your holiday itinerary, we will use all reasonable endeavours to accommodate those changes, although it will not always be possible to do so. Requests for an amendment must be sent by e-mail by the person who made the original booking. It will be good for us, if you would let us know about what changes you want to be made, by calling us before sending an e-mail. If it is possible to make the amendment, it will be subject to an amendment charge of £50 per booking, together with all communication charges or other expenses incurred by the AdventureTime.co.uk as a result of the change. These charges will be payable whether or not the AdventureTime.co.uk succeeds in confirming your requested amendment. Scheduled airlines normally regard name changes as a cancellation and rebooking, and any alteration may incur a 100% cancellation charge in respect of the air fare. ………………………………………………………………………………………………… Cancellation by you If you or anyone on your tour booking decides to cancel the tour you must notify us of the decision as soon as possible. Any notification must be done by e-mail and sent to AdventureTime.co.uk Cancellations are effective on the day they are received by the AdventureTime.co.uk. The following cancellation charges will be payable, depending upon the number of days prior to departure the AdventureTime.co.uk receives your notice of cancellation:
Holiday Insurance When booking a holiday with AdventureTime.co.uk you agree to ensure that you and everyone in your party has adequate insurance cover for your holiday in place before the start date of your trip. Some policies exclude cover for certain activities. ………………………………………………………………………………………………… Passports, Visas and Health requirements British Citizens require a valid full ten-year passport for travel outside the British Isles (this includes all children under the age of 16 who are not already included on an adult passport. If you are applying for a new passport you can no longer add your children's names on it, they will need their own individual passport). Certain destinations require at least 6 months validity remaining on the passport on the date of return from your holiday, and we recommend you ensure that you have at least 6 months validity remaining on your passport before your date of return to the British Isles as a matter of course. ………………………………………………………………………………………………… Accommodation and other services Unless stated otherwise all AdventureTime.co.uk’s prices are per person based on maximum occupancy in a twin or double room. Single rooms carry a supplement. Triples or Quad rooms are usually twin or double rooms with an extra bed. The hotel ratings used on AdventureTime.co.uk website refer to local classifications. Please note that the availability of certain services and attractions can vary according to season, lack of demand, weather conditions, essential maintenance work or other circumstances entirely beyond AdventureTime.co.uk and or our suppliers' control. It is not possible to predict any of the above stated events and we cannot accept any liability for cancellations or curtailment of such amenities in such circumstances. All excursions are subject to demand and weather and therefore we do reserve the right to add or amend those at any time. When you book with AdventureTime.co.uk, you accept responsibility for any damage or loss caused by you or any member of your party. Full payment for any such damage or loss must be paid direct at the time to the accommodation owner or manager or other supplier. If you fail to do so, you will be responsible for meeting any claims subsequently made against AdventureTime.co.uk as a result of your actions. We expect all clients to have consideration for other people. If in AdventureTime.co.uk opinion or in the reasonable opinion of any other person in authority, you or any member of your party behaves in such a way as to cause or be likely to cause danger, upset or distress to any third party or damage to property, we are entitled, without prior notice, to terminate the holiday of the person(s) concerned. In this situation, the person(s) concerned will be required to leave the accommodation or other service. We will have no further responsibility toward such person(s) including any return travel arrangements. No refunds will be made and we will not pay any expenses or costs incurred as a result of the termination. If you encounter any problems with any services supplied by AdventureTime.co.uk during your holiday please inform us, our representative or the relevant supplier (as set out in the Booking Confirmation) at your holiday destination as soon as possible, so that the problem can be rectified locally. ………………………………………………………………………………………………… Medical Tourist service AdventureTime.co.uk would like to make you sure that all of our offers for future customers of Medical Tourism Offer have been checked by us and we are highly recommending the service. Please be aware the contract for any Medical Tourism service will be provided by our partners - medical clinics in Poland and AdventureTime.co.uk is not a part of the contract. Payment for the medical service would be paid by you directly to the clinic.AdventureTime.co.uk takes responsibility to arrange your travel itinerary as hotels, transfers and other tourist attractions which you will need during your stay in Poland. For this service you will be asked to pay before your travel as on AdventureTime.co.uk Terms& Conditions payment procedures. AdventureTime.co.uk chooses the Medical Tourism Partners very carefully and also we put strong attention to ensure that the information on our website are accurate and up-to-date but the information contained in this website is not intended and must not be taken to be the provision or practice of medical advice or services nor a substitute for medical advice, diagnosis or treatment. If you have questions or concerns about your health or treatment, or would like more information, contact your doctor. We do not provide health care services. We provide information solely for informational purposes and do not endorse any particular health care provider or facility or any particular health care service or treatment. Please consult with your own domestic licensed health care provider before seeking the services of any health care provider you learn about via our site. Flights information Flights information on Adventuretime.co.uk website are for general guidance only and are subject to change. AdventureTime.co.uk do not provides flights sales, but we are can help you to find, choose and book your flight. A contract arises between You and the airline. Our tours programs can be modified to your times of flights. Actual flight times will be shown on your flight tickets where applicable. Some airlines do not issue tickets and instead You will receive a confirmation invoice from the relevant airline that You will need to produce when checking in for your flight. Please note that for each flight there are additional terms imposed by the airlines. Some flights may be non-cancellable or non-refundable. Please check all flight rules and any additional terms and conditions of the applicable airline. All flights (including outward, onward and return flights) must be reconfirmed with the relevant airline at least 72 hours prior to commencement of that leg of the journey as they are at all times subject to change.We regret that We cannot accept liability for, or offer You assistance in the event of any delay to your flights (including outward, onward and return flights). The provision of meals or overnight accommodation is entirely at the discretion of the relevant airline. In such circumstances You may be able to claim on your insurance. Please check your policy for details.You are responsible for complying with any airline's terms in relation to check-in times, reconfirmation of flights or other matters. In relation to flight tickets, You are required to use all flight coupons in order of sequence. If this requirement is not met the airline may void the ticket. AdventureTime.co.uk acting as an agent in respect of all flights this means that AdventureTime.co.uk will have no contractual liability to you in respect of the flight product. Complaints In the event that you wish to make a complaint or bring a claim in respect of any of the services, you must notify the nature and details of such complaint to the supplier of the service and AdventureTime.co.uk as soon as possible and in any event no later than 28 days from the end of your holiday booked with AdventureTime.co.uk. AdventureTime.co.uk will not be responsible for any complaints made or claims in respect of any failure to perform the services which have not been notified to it, in writing, within 28 days of the end of the relevant holiday. ………………………………………………………………………………………………… Liability Notwithstanding any other clause of these Booking Conditions, we cannot accept liability or pay any compensation where the performance or prompt performance of our contractual obligations is prevented or affected by ‘force majeure'. For purpose of these Booking Conditions ‘force majeure' means any event which we or the supplier of the service(s) in question could not, even with all due care or foresight avoid. Such events may include war or threat of war, riot, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire and all similar events outside of AdventureTime.co.uk or our supplier's control. AdventureTime.co.uk cannot accept liability to you or any member of your party for any loss of profits, administrative inconvenience, anticipated savings, disappointment, or wasted expenditure suffered in connection with your booking. ………………………………………………………………………………………………… Privacy PolicyIn order to process your booking and to ensure that your travel arrangements run smoothly and meet your requirements we need to use the information you provide such as name, address, and any special needs/dietary requirements and so on. Please note that AdventureTime.co.uk do not send clients personal details to any third party for marketing purposes. AdventureTime.co.uk do occasionally send clients personal details to our trusted suppliers when they are performing a direct service for that client, AdventureTime.co.uk will try and seek approval from the client when this happens but sometimes this is not always possible. The information may also be provided to security or credit checking companies, public authorities such as customs/immigration if required by them, or as required by law. Additionally, where your holiday is outside the European Economic Area (EEA) controls on data protection in your destination may not be as strong as the legal requirements in the UK. We will not, however, pass your information onto any person not responsible for part of your travel arrangements. This applies to any sensitive information that you give to us such as details of any disabilities, or dietary/religious requirements. (If we cannot pass this information to the relevant suppliers, whether in the EEA or not, we cannot provide your booking. In making this booking you consent to this information being passed on to the relevant persons). We hold clients details on our own database, to send out promotional e-mails and our brochure. If you do not wish to receive these please let us know. Clients have a right to ask us at any time what details we hold on them.
Nothing in these Booking Conditions shall exclude any liability of AdventureTime.co.uk for fraudulent misrepresentation or for personal injury or death caused by its negligence. In the event that any provision in these Booking Conditions conflicts with the law under which these Booking Conditions are to be construed or if any such provisions are held by a court with competent jurisdiction to be invalid, such provision or the relevant part shall be deleted and the remainder of the terms of these Booking Conditions shall remain in full force and effect Any failure or delay by AdventureTime.co.uk to insist upon or enforce performance by you of any provision of these Booking Conditions will not be construed as a waiver by AdventureTime.co.uk of it or any rights to exercise it in future or of any other of its rights under these Booking Conditions. All agreements made with AdventureTime.co.uk will be made in England , governed by English Law and subject to the exclusive jurisdiction of the English courts. |
